INSTRUCTION TO CLIENT
The information contained in this letter and attachments is attorney privilege and confidential information intended only for the use of the client to whom it was addressed.

Dear Client,

Please be informed that the insurance company that is responsible for paying your Personal Injury Protection (PIP) benefits is requesting to take an Examination Under Oath (EUO).  At the EUO, an attorney or other representative from the insurance company will ask you questions about your accident, injuries, medical treatment, and other information. It is very important that you attend the EUO.  If you fail to attend, the insurance company may refuse to pay your medical expenses and wage loss. If you cannot attend this appointment, please contact my office immediately.

It is not necessary for me or anyone from my office to attend the EUO since we cannot answer the questions for you.  However, if a problem arises during the EUO please tell the examiner that you want a brief recess and call my office for assistance.  Please follow all of the instructions below:

  1. Review the enclosed Examination Under Oath (EUO) Notice and make the necessary arrangements to attend the appointment on the date, time, and location contained in the Notice.  You must be on time. If you cannot attend the EUO appointment, please contact my office so that we can inform the insurance company and ask them to reschedule the appointment.  However, most insurance companies will only reschedule the appointment once as a courtesy.
  2. Review the enclosed “PIP Statement Questionnaire” which contains the most common questions you will be asked at the EUO.  
  3. Please review the questions pertaining to your medical treatment with your doctor’s office before the EUO appointment.  Please feel free to call me if you are not sure how to answer any of these questions or any other question you may be asked.
  4. If the EUO notice asks you to bring certain items with you to the EUO, only bring the items you actually have in your own possession.  Your doctor(s) and attorney will have most of the items and records being requested.  It is not necessary that you obtain the items that you do not have from your doctor(s) or attorney to take with you to the EUO.
  5. At the EUO, listen carefully to each question.  Answer only what is being asked. Do not volunteer any additional information.  Your answers should be very brief.  If you can answer the question by only saying “yes”, “no”, “I don’t remember”, or “I don’t know”, please do so.  If you do not understand the question, ask the examiner to repeat or rephrase it. Do not answer any question with a guess.  Do not answer any questions asking what you discussed with your attorney or his secretaries. You do not have to answer any questions that ask about your arrest or criminal history, or any other question you believe is too personal and not related to your auto accident.
  6. Do not sign any document at the EUO without my authorization.
